The European Commission designated ChatGPT a Very Large Online Search Engine under the Digital Services Act on August 31, 2026, the first AI chatbot to get that status. What the designation says, what it obliges OpenAI to do, and what it means for your site.

Is ChatGPT a Search Engine? The EU Says Yes

Legally, in the EU, yes. On August 31, 2026 the European Commission designated ChatGPT a Very Large Online Search Engine under the Digital Services Act, the first AI chatbot given that status. With about 159 million monthly EU users, it is now the second largest designated search engine after Google Search.

What did the European Commission actually decide?

The Commission designated three services on August 31, 2026. ChatGPT was classified a Very Large Online Search Engine, or VLOSE. Reddit and Roblox were classified Very Large Online Platforms, or VLOPs.

Designation is triggered by scale. Under the Digital Services Act, a service that reports at least 45 million average monthly active users in the EU falls into the strictest tier. OpenAI reported roughly 159 million monthly active EU users for the six months ending March 2026, more than three times the threshold. Euronews reports Reddit at 57.2 million and Roblox at 48 million.

The comparison worth holding onto is inside the Commission's own list of designated services. There are only three VLOSEs: Google Search at about 364 million EU users, Bing at about 119 million, and now ChatGPT at about 159 million. By the Commission's own numbers, ChatGPT is the second largest designated search engine in the European Union, ahead of Bing. The designations bring the total number of services in the DSA's strictest tier to 28.

Why does the EU call a chatbot a search engine?

Because of what it does when you ask it something. The Commission's reasoning, as reported by Euronews, is that ChatGPT can engage with and respond to users' prompts and queries, including by searching the web. That behaviour is what the DSA's definition of an online search engine reaches, regardless of whether the interface looks like a search box or a conversation.

The Commission's own framing of the two categories makes the split clear. VLOPs are services where users interact and share content, such as social networks, marketplaces and video platforms. VLOSEs are services whose job is indexing and retrieving information from the web, the category that previously held only Google Search and Bing.

Putting ChatGPT in the second group is a statement about function rather than form. A regulator looked at a chat interface, asked what job users hire it to do, and answered: they use it to find things on the web.

What obligations does the designation create, and by when?

Designated services take on the DSA's heaviest duties:

  • Annual systemic risk assessments, covering illegal content, protection of minors, effects on physical and mental wellbeing, fundamental rights, electoral processes and public security.
  • Assessment of algorithmic systems and how they contribute to the spread of illegal content.
  • Independent audits of compliance.
  • Data access for regulators and vetted researchers.

Penalties for non-compliance run up to 6% of global annual revenue. The DSA has already produced roughly 870 million euros in fines, the largest being 550 million euros against AliExpress in July 2026. The Commission's list of designated services also records 200 million euros against Temu and 120 million euros against X.

On the deadline, the two sources disagree, and the disagreement is worth stating rather than resolving silently. The European Commission's announcement says designated services have four months from notification to comply, which from an August 31 designation lands around the end of December 2026 or in January 2027. Euronews reports a compliance date of November 30, 2026. Anyone whose planning depends on the exact date should work from the Commission's own notification rather than from press coverage of it.

Does this change how customers find your business?

Not directly, and it is worth being careful here. The designation is a regulatory fact about OpenAI's obligations. It is not evidence about how much traffic any particular site receives from ChatGPT, and no number in these sources speaks to that.

What it is, is a regulator's assessment of function backed by a user count. A European institution with subpoena power looked at ChatGPT and concluded that it is used to search the web, at a scale placing it second among search engines in the EU. That is a stronger signal than a vendor claim or a survey.

The practical read for a small business is modest and specific. If a meaningful share of your customers are in the EU, then a service the Commission counts at 159 million monthly EU users is answering questions in your category, sometimes by reading pages on the open web. Whether your pages are among the ones it can read and cite is a question worth having an answer to, and it is a different question from where you rank in Google.

The honest caveat: nobody outside OpenAI can see the retrieval behaviour precisely, and anyone selling certainty about it is overselling. The defensible position is that content structured to be understood in isolation, clear answers, plain headings, real sources, works for both traditional search and for assistants that read pages, so the work is not wasted either way.

What should a small business do about this now?

Three things, none of them urgent.

  1. Know whether it applies to you at all. The DSA obligations here land on OpenAI, not on you. Being cited by ChatGPT does not make your business a designated service. If someone tells you otherwise, ask them which article they mean.
  2. Check that your own AI features are on the right side of the rules. The direction of travel in the EU is clear from this designation and from the AI Act transparency duties already in force.   3. Write pages that answer questions. A page built as a self-contained answer to a real question is what a retrieval system can use and what a person actually wanted. That is the same work either way, which is the reason to do it before anyone can prove the return.
